How Burgaw Differs: Town Rules, Soils, Flooding and Streams
Burgaw is an incorporated town whose Unified Development Ordinance replaces Pender County's in the town limits and the Town's extraterritorial jurisdiction (ETJ). The Town issues zoning and floodplain permits there and building permits in town, while septic permitting runs through Pender County Environmental Health. Its 2025 water supply plan reports 50 town water connections with septic systems.
Pender County's soils are mapped in the USDA soil survey. By area inside Burgaw's town limits, its largest map units are Grantham loam, the Exum-Urban land complex, Exum loam, Aycock loam on 3 to 6 percent slopes and Grifton loamy fine sand. USDA's series descriptions call Aycock well drained, Exum moderately well drained, and Grantham and Grifton poorly drained. Citing the 1990 county soil survey, the Town's 2030 plan says every soil in its planning area poses severe limitations for septic tanks, yet NC State Extension says a survey cannot replace an on-site evaluation.
The ground beneath the drain field is where wastewater is truly cleaned, NC State Extension explains. State rules require 12 or more inches of native soil beneath a trench dug into natural ground, above any limiting condition; where more than six inches of that soil is sand or loamy sand, a soil wetness condition less than 18 inches below the trench bottom requires a pressure dispersal system. Advanced pretreatment can lower both figures.
The Town's flood page puts Burgaw's Special Flood Hazard Area at 14.5 percent of the town and ETJ. DEQ's Cape Fear classification schedule lists Burgaw Creek and Osgood Branch as Class C swamp waters, which generally means a 50 foot septic setback.
Pender County Septic Permits: Where to Apply and What Comes Next
Pender County's Environmental Health Division takes the applications, with forms on its Environmental Health page. Drawn from county documents, state law and NC State Extension, these are the county route's steps; the questions below cover two private permit options.
- Application. Use the county's New Structure application plus a plat or site plan showing property lines, easements, CAMA lines, structures, the driveway, wells and drainage.
- Staking and clearing. Flag property lines, corners and easements; stake the planned house, porches, decks and driveway; cut back undergrowth; then phone the office when all is ready.
- Soil and site evaluation. Suitability for septic is judged by a county Environmental Health Specialist, or by a licensed soil scientist if you hire one.
- Improvement Permit (IP). Clears the site for use.
- Construction Authorization (CA). It names the system and may come with the IP. On this route, no building or other construction permit is issued before it.
- Installation. Your installer must be a septic contractor whose NC certification is valid, per the county application.
- County sign-off, then the Operation Permit (OP). Unless an Authorized On-Site Wastewater Evaluator you hire (or, in limited cases, a Private Compliance Inspector) inspects, county staff must approve the system before use or occupancy of a new home; the OP follows that approval.
How the System Type Is Set, and the Systems We Install
On the county route, the Construction Authorization issued after a field investigation names your system type. The EPA's design factors include lot size, soil type, slope, household size and any sensitive water bodies nearby.
We install these types, and any other your permit specifies:
- Conventional system. The septic tank empties into drain field trenches or a bed.
- Conventional system with a lift station. For a drain field so far from the tank that the water would not reach the drain lines effectively.
- Chamber system. A drain field built from a series of connected chambers.
- Low-pressure pipe (LPP) system. Small pipes at three to six feet of pressure head spread effluent over the whole field.
- Drip distribution system. A large dose tank after the septic tank holds wastewater for timed dosing of drip lines 6 to 12 inches below the surface.

Coastal Septic Solutions was contracted to fix an issue caused by another company. They were super professional and polite and extremely helpful anytime I needed to call to find out the process and when I would expect or could expect the repairs to take place. The day they arrived everybody was in and out very quickly and took into account that I work from home and managed to keep the noise to a minimum and most of the time I forgot they were even outside my house. Definitely recommend their services.

I contacted Coastal about coming out to take a look at my septic tank lines. I had a issue with roots growing into the lines causing them not to drain properly. When I contacted them they were very understanding and came right out to look at the issues. They corrected the problem and even put out grass seed where they had to dig up the lines!

Our septic tank wasn't draining properly and Jonathan came and assessed the situation quickly that we needed a new drain field. He obtained the necessary permit, all the materials needed were delivered the next day, and he and his crew came the next day. They laid a 55ft drain field, cleaned up the yard and were done by mid afternoon. He and his crew work well together and do a beautiful job!!! They are all very personable and we highly recommend Coastal Septic Solutions for any septic problems. Charles and Marysusan Rice.

Thanks and be safe.
How We Put In a Burgaw Septic System
- Permits. On the county route, Pender County issues the IP and CA after the site evaluation.
- Free estimate. Email the CA or send it with this page's form for an estimate on that system.
- Clearing. Trees and bushes in the system's way may need removing.
- Building the system. Your CA's system type guides everything we put in, tank to drain field.
- Inspection while open. Before the work is covered, it gets the inspection described in the permit steps above.
- Covering the field. State rules require settled cover of six inches or more, with runoff diverted away; afterward, keep it grassed against erosion.
- Ready for use. The county's OP authorizes use, or, where an evaluator you hired inspected, the evaluator's written verification lets you start the system.
What Sets the Pace of a Burgaw Septic Project
These can hold a stage back:
- A complete application. The county form warns that missing items stop processing and bring lengthy delays.
- A staked, open site. Pender County's application says an unstaked property will not be evaluated, and dense growth must be bush-hogged or thinned.
- Recorded documents. All parcels, easements and declarations must be recorded before the county issues a CA.
- Flood hazard areas. Inside one, the Town's Floodplain Development Permit, which covers septic work, comes before any development activity.
- Inactive applications. One awaiting your action expires 12 months from its filing date.
Building New, Replacing a System or Serving a Business
New construction. Under state rules a 1,000 gallon tank is generally the minimum for one home of up to four bedrooms and a 1,250 gallon tank for five, doubled if a grinder or sewage lift pump comes before the tank.
Replacement. Pender County has its own repair application, and unless you take a private option, a health department permit comes first. Since the early 1980s the law has required most permitted house sites to keep a repair area for a second drain field (NC State Extension); the system there could be a completely different, more sophisticated type.
Commercial. A business lists its employee count, square footage and similar details on the application to set daily design flow.

Protecting Your New Septic System
- File an as-built diagram with your permits (ask for one if needed); NC State Extension notes it may show details not on the permit.
- The EPA calls for an inspection at least once every three years and puts typical household tank pumping at three to five years; our septic tank pumping crew does it.
- Pumps, float switches or other mechanical parts generally mean a yearly inspection.
- Parking, driving and building on the drain field are all off limits.
- Turn roof drains and other rainwater drainage away from the field.
- Native grasses and ground covers suit the field best; keep trees far enough back that roots cannot reach the system.

Answers for Burgaw Owners Planning a Septic System
Is there anything to check before I buy a Burgaw lot that needs septic?
Hold off on closing until an Improvement Permit is issued, as NC State Extension advises anyone buying land to build on. Inside Burgaw, also ask the Town whether its sewer reaches the lot.
Does Pender County have to do my soil evaluation?
No. State rules let you hire a licensed soil scientist for the soil and site evaluation, and state law offers two private permit options, the Engineered Option Permit and the Authorized On-Site Wastewater Evaluator option, each needing a Notice of Intent to Construct filed with the local health department before work starts.
How long do Pender County septic permits stay valid?
Under state law, an Improvement Permit issued with a site plan is good for five years, and one issued with a plat never expires; a changed site plan, plat or intended use can bring revocation. A Construction Authorization lasts as long as its Improvement Permit, and one issued with it needs a health department preconstruction conference once over five years old.
How do I protect the drain field area during construction?
Keep grading and digging off any spot that might hold the drain field; Pender County's application warns such work can ruin a site. After permitting, leave the permitted area undisturbed: the county says damaged soil will likely get the permit revoked; temporary fencing may be needed.
Who should I talk to before adding a bedroom, an apartment or a pool?
Start with Pender County's health department; its authorization, NC State Extension explains, confirms your system and repair area stay undamaged and big enough for the plan. Where a project adds neither design daily flow nor wastewater strength, G.S. 160D-1110 bars withholding the building permit under that section from an owner who submits an existing system inspection exemption affidavit and affirms local and state setbacks will be met. Burgaw also requires adequate water and sewer, or an approved septic system, for each accessory apartment.
